What Tebra says
“This Business Associate Agreement (the “Agreement”) shall be incorporated into the Terms of Service for Customers that are Covered Entities (as defined in the HIPAA Rules) and that provide Protected Health Information (“PHI”) (as defined in the HIPAA Rules) to Tebra Technologies, Inc. and its subsidiaries (“Tebra” or “Business Associate”) in connection with the software and services they have purchased.”
What the BAA covers and excludes
Excludes or limits, in Tebra's words:
- "Client acknowledges and agrees that (i) this BA Agreement does not apply to payment processing under HIPAA Section 1179 (42 USC 1320d-8), and (ii) a Business Associate Agreement is not required between Tebra and its Subcontractors that only provide products and services related to payment processing."
What this means for ad tracking
Tebra runs booking, intake and records for many practices, so it usually sits right where the ad tracking happens. A pixel on a booking or intake page can send the page address, the appointment type and the visitor's identifiers to Meta, Google or TikTok.
A BAA with Tebra covers the patient data Tebra holds for you. It does not cover what an ad pixel on a Tebra page sends to an ad platform, because the ad platform is a separate recipient that has not signed your BAA. Meta's Business Tools Terms bar health information, so the booking has to reach Meta without it.
