What Smartsheet says
“Customers are only permitted to upload PHI into the Subscription Services if (1) using PHI Eligible Services and (2) they have executed a Business Associate Agreement (BAA) with Smartsheet.”
“Only Enterprise users have the ability to implement the Smartsheet features and functionalities necessary for you to meet your obligations under HIPAA.”
What the BAA covers and excludes
Excludes or limits, in Smartsheet's words:
- Smartsheet lists as PHI ineligible: "Smartsheet Trials, Pro Plan, Business Plan", "EAP Members on any plans", "Brandfolder" and "Smartsheet University, Community, and other Smartsheet Sites".
- HIPAA features are "only available to Enterprise (excluding Legacy Enterprise) plan users". (Smartsheet HIPAA Implementation Guide)
- "Please note that Add-Ons are NOT part of the underlying Subscription Service for purposes of the BAA or this guide and Smartsheet makes NO representations that implementation or use of Add-Ons is compliant with HIPAA." (Smartsheet HIPAA Implementation Guide)
What this means for ad tracking
Teams run intake trackers, referral logs and campaign plans in Smartsheet, and a row can tie a patient to the care they asked about.
A BAA with Smartsheet covers that data on the Enterprise plan. It does not cover add-ons or an ad platform, so a lead or booking you count as a conversion should reach Meta or Google with no health details.
Curve Compliance closes that gap: it sends the conversion itself server-side, under a BAA it signs on every plan, so your campaigns keep a conversion signal without a pixel carrying patient data. Book a call to see it on your own funnel.
A business associate agreement binds only the vendor that signs it, so each vendor that handles patient information for you needs its own.
How Curve helps
- Keep Smartsheet for what it does well. Curve carries the conversion signal to your ad platforms separately, under its own BAA.
- Server-side conversion tracking in place of pixels: conversions reach your ad platforms from Curve's server, not from the patient's browser.
- A fixed field list per platform, so each ad platform receives only the fields set for it.
- PHI-like pattern detection checks every event before it goes out, and neutral event names keep conditions and treatments out of what the platforms see.
- When identifiers are enabled, Curve hashes them with SHA-256.
- Consent management for your site, alongside the tracking.
- A HIPAA-compliant setup done by Curve's team, with a BAA signed on every plan.
